A Montgomery County woman filed a lawsuit against her stepson alleging public defamation negligence in 2014 and thereafter.
Theresa Roemer filed a petition against Maximillian Roemer of Galveston in Galveston County District Court on June 29, seeking injunctive action to prevent him from engaging in public defamation, and claiming he is in violation of a previous settlement agreement between them made in August 2014.
The suit states that the defendant is 32, single, unemployed and troubled. According to the suit, Maximillian has posted malicious statements against Theresa on public websites since her marriage to his father, Lamar Roemer, more than five years ago.
According to the filing, Theresa runs an accessories and clothing business. After the defendant allegedly began posting defamatory comments about her on websites and blogs in summer of 2014, the suit states, she sued him and won a temporary restraining order on July 28, 2014.
The parties entered into a settlement agreement on Aug. 7, 2014. Claiming that Maximillian has violated the agreement, the plaintiff states that he has committed libel by making false statements that damaged her reputation and business.
Theresa requests the court to order that all electronic devices belonging to the defendant be surrendered for imaging; that he submit to an oral deposition, and undergo an independent psychiatric exam.
Claiming intentional infliction of emotional distress, the plaintiff seeks a temporary restraining order, an injunction to prevent further contact, compensation for damages, attorney’s fees, expenses, and costs.
