Auto worker alleges denial of overtime pay

A Brazoria County man is filing a class action lawsuit against several related business entities based in Friendswood, alleging deviation from labor law.

Daniel Woods filed a lawsuit individually and on behalf of a putative class June 19 in the Galveston Division of the Southern District of Texas against EEE Enterprises, doing business as Friendswood Kwik Kar, EEE Alvin, doing business as a Alvin Kwik Kar, Triple E-GP Inc., and James Edwards, alleging violation of the Fair Labor Standards Act (FLSA) by failing to provide overtime pay to its employees during a three-year period.

According to the complaint, Kwik Kar unlawfully denied Woods and other nonexempt employees standard overtime rate pay when they routinely exceeded 40-hour work weeks. Woods was employed between October 2013 and November 2014. The suit says the defendants unlawfully failed to maintain accurate time and pay records for its workers. The lawsuit defines the putative class as all hourly workers employed by Kwik Kar during the last three years through the present.

Woods seeks compensation for unpaid overtime wages, liquidated damages, pre- and post-judgment interest, attorney fees, expenses and costs. He is represented by attorneys Melissa Moore and Curt Hess of Moore & Associates in Houston.
