Company sued by ex-delivery man for alleged failure to pay him for overtime

 A delivery man is suing his employer for allegedly failing to pay him for overtime.

Alfred Weeks filed a complaint July 22 in U.S. District Court for the Southern District of Texas, Houston Division, against NDLI Inc. and NDL Contracting Texas LLC.

Weeks worked for the defendants from Aug. 20, 2014, to March 7, 2015, as a delivery carrier, picking up and delivering dental and automotive supplies around the Houston area.

During that time, the lawsuit states, he regularly worked from 6:30 a.m. to 6 p.m. Mondays to Fridays, and 7:45 a.m. to 4:30 p.m. on Saturdays -- about 60 hours a week.

According to the lawsuit, the defendants never paid Weeks for overtime when he worked more than 40 hours a week.

The plaintiff, citing a violation of the Fair Labor Standards Act, seeks unspecified unpaid wages and overtime compensation, liquidated damages, attorneys' fees, expenses and court costs.

The plaintiff is represented by Thomas H. Padgett Jr. of the Ross Law Group in Bellaire, and attorneys Charles L. Scalise and Daniel B. Ross in Austin.
