A bank is suing a couple for taking out a home loan but going into default.
Communitybank of Texas NA, formerly known as Vista Bank Texas, filed a complaint July 16 in Jefferson County District Court against Robert and Darlene O'Neal.
The plaintiff, of Jefferson County, issued a note to the defendants with a maturity date of June 22, 2015, the lawsuit states -- $536,566.12, bearing interest at 5 percent.
When the note matured, the lawsuit states, the plaintiff demanded payment, waiting 30 days with no payments.
The principal now has unpaid accrual of $737.52, late charges of $19.02, legal fees of $1,780 and insurance payments of $15,690.22.
The plaintiff, citing breach of contract, seeks the principal and fees still due, plus pre- and post-judgment interest, attorneys' fees and court costs.
