Couple blames Bexar County man for injuries in traffic collision

Galveston

A Galveston couple is suing a Bexar County man, alleging negligence in a traffic collision.

Dalia Garza and Fernando Garza of Galveston filed a lawsuit July 20 against Pedro Lozano of Adkins in Galveston County District Court, alleging negligence.

According to the complaint, on Dec. 20, 2014, Lozano’s vehicle was stopped in a lane of traffic on the causeway connecting Galveston Island to the mainland where cars are prohibited from stopping or parking on a bridge. The suit also says Lozano did not take accurate precautions to warn other motorists that his vehicle was blocking traffic.

The lawsuit states a vehicle driven by Fernando Garza struck Lozano's stopped vehicle, causing serious injuries to himself and Dalia Garza.

The suit says Lozano was negligent in failing to maintain his vehicle, failure to warn motorists his vehicle was stopped in a lane of traffic, failing to steer his vehicle to the roadside, failing to keep a proper lookout and failing to act as a prudent driver.

The Garzas seek damages between $200,000 and $1 million, plus court costs. They are represented by attorneys Darrell Apfell, S. Benjamin Shabot, Lauren F. Arisco and D. Blake Apfell of Bettison, Doyle, Apffel & Guarino in League City.

Galveston County District Court case number 15-CV-0751.
