Boat owners sue boating repair shop for fraud

Two Galveston County residents are suing Evans Marine Services for fraud and misrepresenting its business.

Alan Pereyra and Steven Pereyra filed a suit June 1 in the Galveston County District Court against Bryan Evans, doing business as Evans Marine Services, alleging negligent misrepresentation, fraud and violation of the Texas Deceptive Trade Practices Act.

According to the suit, on Jan. 29, the plaintiffs took their boat to Evans Marine in order to have their 2012 250 Suzuki outboard motor removed for repair work. The suit claims Evans falsely repaired and/or rebuilt the Suzuki outboard motor and dishonestly sold a new 2015 250 Suzuki outboard motor to the plaintiffs.

According to the plaintiffs, Evans failed to refund of all the monies paid for the purchase and anticipated installation of the new 2015 250 Suzuki Outboard Motor, totaling $20,343.61. The Pereyras are seeking damages totaling more than $20,000, including court costs and attorney fees.

The plaintiffs are represented by attorney Nelson S. Ebaugh in Houston.
