Utility company sues Galveston County road excavation crew

A Galveston County utility company is suing a local excavation crew, claiming it damaged its facilities.

GTE Southwest Inc., doing business as Verizon Southwest, filed a suit June 8 in the Galveston County District Court against Southwestern Road Boring L.P.

According to the suit, on June 25, 2013, the defendant engaged in boring/excavation activities at a site in Dickinson. The plaintiff, a utility company, claims Southwestern Road struck and damaged GTE’s underground fiber telecommunications cable and conduit facilities, which were lawfully in place at that location.

GTE is accusing Southwestern Road of trespassing, negligence and is seeking damages of $100,000 dollars or less. The plaintiff is represented by attorney David Redford of Brown Sims in Houston.
