A Dallas trucking company is suing an Oregon trucking business, alleging a collision occurred because the driver parked on the side of the highway to urinate.
Stevens Transport Inc., Paragon Leasing and Stevens Transport Driver Accident/Injury Plan filed a lawsuit June 9 in the Tyler Division of the Eastern District of Texas against Global Transport and Patricio Espinosa-Herzberg, alleging negligence.
According to the complaint, on Jan. 9, on Interstate Highway 20 in Gregg County. Robert Harris, an employed driver of Stevens Transport, was driving a tractor and trailer vehicle owned by Paragon when he struck a trailer owned by Global Transport of Portland. The suit says the trailer obstructed a portion of I-20 and was illegally parked partly on the side of the highway. The lawsuit states the defendant, Espinosa-Herzberg, had parked the tractor and trailer illegally in order to urinate in a bottle.
The plaintiffs seek damages of more than $75,000. They are represented by attorney Warren McCollum of Fenley & Bate in Lufkin.
