Harris County residents sue home insurance company after denying claim

A Harris County couple is suing a home insurance company after it denied their damage claim. 

Ronald and Chandra Garrett filed a suit June 10 in the Houston Division of the Southern District of Texas court against Lexington Insurance Co., headquartered in Massachusetts. 

On April 26, 2014, the plaintiffs’ Humble home was damaged due to an accidental discharge of water. The Garretts submitted a claim related to this covered loss that Lexington denied.

According to the plaintiffs, Lexington’s denial was not based upon a bona fide dispute but was arbitrary and constitutes a pretextual denial. The Garretts claim the sudden and accidental water loss that caused the damages is covered under their policy.

The plaintiffs are suing the defendant for breach of contract and violating the Texas Insurance Code. The Garretts are seeking damages of an unspecified amount and are represented by attorney Joshua Davis in Houston.
