Woman claims former employer wrongfully denied long-term disability benefits

A Smith County Woman is suing her former employer and disability insurance provider for wrongfully denying long-term disability benefits.

Judy M. Allen filed a lawsuit against Life Insurance Company of North American and Ingersoll-Rand Company on Aug. 3 in the Marshall Division of the Eastern District of Texas, citing wrongful denial of benefits.


The suit states Allen was an employee of Ingersoll Rand at its TRANE Carrier Plant located in Tyler. During her employment she faced a carpal tunnel injury that eventually resulted in permanent disability. As a participant in the company’s long-term disability insurance plan, Allen was eligible for disability insurance benefits. 

She has applied and continually been denied all long-term disability benefits and has exhausted all administrative appeals of the denial.

She has been awarded disability benefits under the Social Security Disability Insurance program, the suit states.

Allen is seeking damages including payment of benefits, lost interest or appreciation monies or assets, attorney fees, costs of court and expenses of litigation and pre and post judgment interest.
