A Texas woman is suing Prudential Insurance over claims it wrongfully denied benefits due to her.
Irina Schmedes filed the complaint Aug. 12 in the Marshall Division of the Eastern District of Texas against the Prudential Insurance Co. of America, alleging wrongfully denied benefits, violation of good faith and fair dealing, and unfair and deceptive business practices.
Schmedes, formerly a licensed physician in Texas, could no longer perform her occupational duties as of June 2, 2014, and she made a claim to benefits under Prudential Insurance's long-term disability benefits policy on July 23, 2014, the suit states.
The suit then alleges that Prudential Insurance denied benefits to Schmedes in December under that policy based on an improper application of the governing standard of disability.
Schmedes seeks damages, the unpaid benefits due to her as well as future benefits, plus attorney fees and court costs.
