HOUSTON--A Polk County worker is suing his former employer, alleging unpaid overtime wages.
John Harold Windham, of Onalaska, filed a lawsuit Aug. 14 in the Houston Division of the Southern District of Texas against Conroe Concrete, alleging violation of the Fair Labor Standards Act.
According to the complaint, Windham was a dispatcher for Conroe Concrete for approximately 23 years until his resignation July 23. The suit says he was incorrectly classified as an "exempt" employee, despite not performing any functions that would classify him as such.
The suit also alleges he was owed additional compensation as a "load bonus," for materials sold from the New Waverly plant, some of which he says were "short-filled," thus causing him to be shortchanged in the process, as well as the customers.
Windham seeks the overtime and other unpaid wages, as well as garnered interest, plus court costs and attorney fees. He is represented by attorney Gregg M. Rosenberg, of Rosenberg & Sprovach in Houston.
