A Florida company is suing five Texas residents regarding a lease agreement controversy.
Belfast FSS of Florida, filed a civil action lawsuit Aug. 3 in the Houston Division of the Southern District of Texas against Ronald E. Bruno, Christopher Garcia, Sergio Lopez, Patrick G. Mendoza and Troy J. Williams, alleging breach of contract.
According to the complaint, the defendants, as guarantors for Nogal Energy to leases agreed to by Belfast and Nogal, failed to pay rent due to Belfast under the leases for the months of August-September 2014 across two properties. The suit says on Sept. 26, 2014, Belfast provided written notice of termination of the leases and notice to vacate, then, on Oct. 21, 2014, Nogal filed for bankruptcy.
The lawsuit states the plaintiff is entitled to recover the unpaid rent sums plus interest under sections of the lease agreement.
Belfast FSS seeks to recover the unpaid prorated rent, plus interest, and liquidated damages of $72,000 for one property and $300,000 for the other, plus attorney fees and court costs. It is represented by attorneys Marc G. Matthews in Houston, and Christopher K. Ralston and Jeremy T. Grabill of Phelps Dunbar in New Orleans (pending pro hac vice).
