Family sues General Motors, alleging negligence following fatal collision

Beneficiaries of Linda Cox's estate are suing General Motors, alleging negligence in a car accident that killed Linda Cox and injured her spouse.

James Cox, Bryn Cox, Stephaney Jean Arnold and Bridget Harris, individually and for the estate of deceased Linda Cox, filed a civil action lawsuit July 31 in the Marshall Division of the Eastern District of Texas against General Motors, alleging negligence.

According to the complaint, on April 22, James Cox was driving a 2001 Chevrolet Monte Carlo eastbound on state Highway 154 in Wood County, with Linda Cox riding as a passenger, when another vehicle traveling westbound on the highway crossed into the eastbound lanes and hit the Cox's vehicle head-on.

Although both passengers in the Cox vehicle were properly seated and wore seat belts, James Cox lost a leg in the crash and Linda Cox was fatally injured, the suit says.

The lawsuit states the Cox's vehicle was not reasonably fit for foreseeable accidents, that it lacked structural integrity that rendered safety systems ineffective, was not properly tested or subjected to rigorous engineering analysis, failed to provide adequate restraint, failed to utilize safer alternative designs, and that these defects and negligence were the cause of the Cox's injuries.

The plaintiffs seek actual damages, plus costs of the suit. They are represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas, and by Rachel E. Montes of Montes Lewis Law in Irving.
