Independence Oilfield Chemicals sued over unpaid overtime allegations

Overtime

A Texas man is suing his former employer, Independence Oilfield Chemicals LLC, over claims it did not pay overtime wages.

Mike Cormier, individually and for all others similarly situated, filed a collective action complaint Aug. 20 in the Houston Division of the Southern District of Texas against Independence Oilfield Chemicals LLC, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The complaint states that Cormier was employed in a blue-collar job as a fluid technician, regularly working more than 80 hours per week.

Independence paid Cormier and others similarly situated a base salary regardless of hours worked per week and did not pay time-and-a-half for overtime hours worked.

Cormier and others in the collective seek to recover unpaid overtime wages and other damages, plus court costs and attorney fees.

He is represented by Michael A. Josephson, Lindsay R. Itkin, Andrew Dunlap, and Jessica M. Bresler of Fibich, Leebron, Copeland, Briggs & Josephson in Houston and Richard J. Burch of Bruckner Burch in Houston.
