Former cook sues Los Arcos Mexican Restaurant & Sports Bar, alleging unpaid overtime

A Denton County woman is suing her former employer and its corporate officer, alleging unpaid overtime wages.

Gloria Hernandez, individually and for all others similarly situated, filed a lawsuit Aug. 21 in the Sherman Division of the Eastern District of Texas against Asiria Corporation, doing business as Los Arcos Mexican Restaurant & Sports Bar, and Onesimo Nevarez, alleging federal minimum wage violation and federal overtime wage violation.

According to the complaint, during the time Hernandez was employed by the defendant as a cook, from May 10, 2009 to Aug. 16, 2015, she was paid an average rate of $8.82 per hour. The suit says Hernandez worked an average of 68 hours per week but was not paid time-and-a-half for hours worked past 40 hours per week, in violation of the Fair Labor Standards Act.

The suit further alleges the plaintiff was paid nothing at all during her last week of employment.

Hernandez seeks double damages, plus attorney fees and court costs. She is represented by attorneys Robert Manteuffel, J.H. Zidell and Joshua A. Peterson of J.H. Zidell in Dallas.
