Harris County homeowners sue Allstate, alleging water damage

A Harris County couple is suing Allstate and two subcontractors, alleging substantial water damage to property they own in Galveston County.

Eliseo and Dolores Nerie filed a lawsuit June 15 in Galveston County District Court against Allstate Texas Lloyds, ServPro Inc., Robert Beall and Keith Thompson, alleging breach of contract, negligence and deceptive trade practices.

According to the complaint, Allstate and Servpro, and their representatives, mishandled the Neries' water-damage case and indeed caused further destruction to their home. The suit says on May 10, 2013, the plaintiffs' home at 12531 West Ventura, Galveston, and many of its contents, sustained severe water damage as the result of a leaky plumbing line in the upstairs bathroom.

The lawsuit states the defendants--Allstate and Servpro and their agents--misrepresented themselves, denied or underpaid the plaintiffs' claim and, in the case of Servpro, inflicted further water damage when workers opened an outside water line and flooded the home. The suit also charges all parties with unfair settlement practices and other violations of the Texas Insurance Code.

The Neries seek up to $1 million, and no less that $200,000, plus fees and court costs, and reserving the right to sue for monetary relief. They are represented by attorney Nishi Kothari of Arguello, Hope & Associates in Houston.
