Galveston County woman sues car insurance firm, alleging refusal to pay benefits

A Galveston County woman is suing her car insurance company, alleging it refuses to pay uninsured/underinsured motorist coverage following a vehicle accident the woman was in.

Kim Shapiro filed a lawsuit July 16 in Galveston County District Court against USAA Casualty Insurance Company.

The complaint states on Oct. 14, 2011, Shapiro's 1999 Chevrolet Tahoe was struck by Ruby Reyes' vehicle at the intersection of Baker Street and 34th Street in Dickinson.

The suit says Reyes was an uninsured driver and Shapiro should have been protected by her uninsured/underinsured motorist insurance policy with USAA.

However, according to the complaint, USAA has refused to pay the benefits due Shapiro under the insurance contract. The suit says the plaintiff has suffered past and future pain and anguish, medical expenses, physical impairment and disfigurement as a result of the accident.

Shapiro seeks monetary relief between $100,000 and $200,000, plus court costs.

She is represented by attorney Russell G. Burwell III of Burwell Nebout in Texas City.
