Shelby County man blames trucking employee for rear-end collision

A Shelby County man is suing a Wisconsin-based long haul trucking company and one of its employees, alleging injuries he sustained in a car wreck.

Jimmy Moore filed a lawsuit July 31 in the Marshall Division of the Eastern District of Texas against Blue Leasing Corporation Inc. of West Bend, Wis., and Mark Bricko, alleging negligence.

According to the complaint, on May 4, Moore was driving an 18-wheeler on state Highway 59 North when Bricko rear-ended Moore's vehicle while operating a Peterbilt commercial motor vehicle for Blue Leasing Corporation.

The suit faults Bricko with failing to maintain a proper lookout, not slowing down or keeping a sufficient distance between his vehicle and the plaintiff's, and failing to apply his brakes in a timely manner. The lawsuit also alleges Blue Leasing Corporation was negligent in allowing Bricko to operate its commercial motor vehicle, as well as negligent in the hiring and training of Bricko.

The plaintiff alleges he has and will continue to suffer physical pain, mental anguish, physical impairment and disfigurement, loss of capacity to work, and medical expenses.

Moore seeks more than $75,000 in damages, plus court costs and other relief deemed appropriate by the court. He is represented by attorney J. Mark Mann of Mann, Tindel & Thompson in Henderson and attorney Don Wheeler of the Law Office of Don Wheeler in Center.
