A Collin County man is suing a Kansas company, alleging lack of restitution for his steel detailing services.
Glenn Ihde filed a lawsuit Aug. 28 in the Sherman Division of the Eastern District of Texas against HME, Inc, of Topeka, Kansas, alleging lack of payment.
According to the complaint, Ihde, a structural steel detailer, was hired to perform services for the Laramie High School Project by HME, Inc., for an agreed-upon amount of $132, 200, and both parties signed a contract, explicitly detailing the services to be performed.
At certain key points in the service, the suit says, HME requested specific changes, meaning Ihde had to reorder and re-plan the initial assignments according to the original plan, thus causing setbacks in the assignment and causing the plaintiff to have to put his other work on hold in order to accommodate the changes.
Despite the extra work, the plaintiff alleges he delivered on the services he was hired to do. However, the cost of accommodating the changes rose significantly from the originally agreed-upon amount, and at the plaintiff's own expense, the suit says.
Ihde sent the defendant an adjusted bill, incorporating the additional charges. The defendant, to date, has paid $28,170 toward the first billing of $31,300, the suit says, but has yet to pay the remainder, nor has it paid the second amount billed, $24,710.
The plaintiff says he is still owed $126,280.
Ihde seeks restitution of said amount, along with attorney fees and court costs, plus interest and damages as seen fit by the court. He is represented by attorney A. Scott Campbell of the Law Offices of A. Scott Campbell in McKinney.
