HOUSTON--An insurance company is suing Houston contractors, alleging non-payment to suppliers and subcontractors for supplies and labor.
International Fidelity Insurance Company, a Pennsylvania-based company, filed a lawsuit Aug. 25 in the Houston Division of the Southern District of Texas against against Veritas Supply, Inc., doing business as Veritas Mechanical and Jesus S. Ocampo and Elvira T. Ocapmo, all of Houston.
According to the complaint, performance bonds were issued on behalf of Veritas in connection with multiple construction projects in Texas. One was paid but another, for the so-called "Hampton Inn project," was not,the suit says.
In addition, International Fidelity has continued to incur losses as a result of its involvement with said dispute over unpaid bonds and the cost of various supplies and labor costs. A settlement for $345,620.00 was allegedly made as consideration, but losses in the amount of $538,540 were incurred and further loss is expected as a direct result of the continuing dispute, the suit says.
International Fidelity Insurance seeks attorney fees and expenses, interest incurred leading up to and beyond the court case until monies are paid, and requests relief for these and other damages in the form of the amounts incurred therein, as the court sees fit. It is plaintiff is represented by attorney Ryan D. Dry, of Krebs, Farley & Pelleteri in Plano.
