Houston women sue doctors over claims of unpaid overtime wages

Two Houston women are suing their former employer over claims of unpaid overtime wages.

Nohemy Flores and Rocio M. Hernandez filed a complaint Aug. 25 in the Houston Division of the Southern District of Texas against David T. Nemoto, M.D., P.A., and David T. Nemoto, M.D., alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

Flores was employed by the defendants as a medical assistant earning $11 per hour from January to July 2014, and Hernandez was employed by the defendants as a front desk clerk earning $15 per hour from Sept. 20, 2013, to Sept. 30, 2014, according to the complaint.

The complaint states that during their employment, the plaintiffs regularly worked more than 45 hours per week but were not paid time-and-a-half for overtime hours worked.

The plaintiffs seek damages for unpaid overtime wages, liquidated damages, and attorney fees and court costs.

They are represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
