Circle Z Pressure Plumbing sued over unpaid overtime wages allegations

Two Eastern Texas men are suing their former employer over claims of unpaid overtime wages.

Daniel Perry and Desmond Williams, individually and for all others similarly situated, filed a civil action complaint Sept. 2 in the Marshall Division of the Eastern District of Texas against Circle Z Pressure Plumbing LLC, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The complaint states that while the plaintiffs were employed as operators for the defendant, they were paid an hourly rate and were paid overtime wages for hours worked in excess of 40 hours worked per week.

The plaintiffs regularly worked between 60 and 80 hours per week for the defendant, but the defendant did not include job bonuses in calculating operators' regular pay rates, so overtime wages were improperly calculated, resulting in underpayment of overtime wages.

The plaintiffs and others similarly situated seek to recover their unpaid overtime wages, liquidated damages, all available equitable relief, and costs of the suit.
