Swire Oilfield sued over unpaid overtime allegations

A Houston man is suing his former employer over claims of unpaid overtime wages.

Jerry McCain, individually and for all others similarly situated, filed a complaint Sept. 1 in the Houston Division of the Southern District of Texas against Swire Oilfield Services LLC, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The complaint states that during the time he was employed as a field operator for the defendant, McCain was paid a salary rate plus a day rate basis with no overtime pay. However, because Swire Oilfield's field operators regularly worked more than 90 hours per week, they have suffered losses in unpaid overtime wages.

McCain and others in the class seek to recover unpaid overtime compensation, liquidated damages, attorney fees, and court costs.
