Tony's Used Cars sued over negligence allegations after car falls on employee

A Texas City couple is suing a La Marque auto repair company for alleged negligence in the case of injuries sustained at the workplace.

The suit was filed June 25 in Galveston County District Court by Jesse Whittington and Sandy Whittington against Tony's Used Cars Inc.

According to the complaint, the plaintiff sustained serious and permanent injuries while at the defendant's job site when a car fell on top of him on Jan. 20. The complaint states that faulty equipment, lack of training and lack of proper supervision led to the incident. Charges include negligence and gross negligence, both of which caused the situation that led to the plaintiff's injuries. In addition, the defendant does not subscribe to workers' compensation insurance in Texas and so the defendant has forfeited the use of the comparative responsibility statute continued therein.

The plaintiffs seek damages for medical care expenses, pain and suffering, physical disfigurement, loss of earning capacity, attorney's fees court costs. They also want a jury trial.

The plaintiffs' attorneys are Joshua Estes and James Magers of the Estes Law Firm in Richmond.
