Darr Equipment and driver sued over claims of negligence following vehicle collision

An Orange County man is suing a Beaumont equipment company and one of its drivers following a vehicle collision and his alleged injures as a result.

Richard McFarlain filed a complaint Sept. 3 in Jefferson County District Court against Darr Equipment Co. of Houston and Christopher Gene Campbell, alleging negligence.

The complaint states that on Aug. 25, 2014, Campbell, while employed by Darr Equipment and driving one of its trucks, struck McFarlain's vehicle from behind.

The complaint states Campbell was negligent in his failure to control speed, failure to maintain proper lookout, failure to timely apply brakes, failure to operate the vehicle in a safe manner, and other negligent acts or omissions.

As a result of the collision, McFarlain suffered severe injuries, physical pain and mental anguish, lost earnings, damage to earning capacity, disfigurement, physical impairment, property damage, and has incurred medical expenses, according to the complaint.

McFarlain seeks monetary relief between $100,000 and $200,000, plus costs of the suit. He is represented by David P. Wilson of Provost Umphrey LLP in Beaumont.
