A female worker is suing two gentlemen's clubs, individually and on behalf of all similarly situated individuals, alleging violations of the Fair Labor Standards Act.
Jennifer McGehee filed a lawsuit Aug. 7 in the Marshall Division of the Eastern District of Texas against Bare Assets, Midnight Lace and Marshall Sealey.
According to the complaint, McGehee, in the three years she worked as an entertainer at the gentlemen's clubs, never was paid overtime for working more than 40 hours a week, per the FLSA. The suit says she had to pay a "house fee" to the defendant as a percentage of her tips and had to share tips with other employees who do not regularly receive them.
The plaintiff alleges although the defendants say she and her fellow employees are independent contractors they are actually employees, based on FLSA guidelines, which include defendant's practices of scheduling work days and hours, supervising the entertainers and reserving the right to hire and fire.
McGehee seeks unpaid back wages, court costs, attorney fees and other relief that the court finds appropriate. She is represented by attorneys J. Derek Braziel and J. Forester of Lee & Braziel in Dallas, and Jack Siegel of the Siegel Law Group, also in Dallas.
