Nacogdoches County man sues former employer, alleging unpaid overtime

A Nacogdoches County man is suing his former employer, alleging unpaid overtime wages.

Franklin Matchett filed a complaint Sept. 8 in the Tyler Division of the Eastern District of Texas against Legacy Pressure Control Inc. and Robert Myrick, alleging unpaid overtime in violation of the Fair Labor Standards Act.

According to the complaint, when the defendants employed Matchett as a pump supervisor from September 2013 to February 2015, he frequently worked 13 or 14 hours per day, seven days a week, but was only paid salary for a 40-hour workweek and was not paid overtime.

The lawsuit alleges the defendants wrongly classified the plaintiff as exempt from FLSA requirements.

Matchett seeks to recover unpaid overtime compensation, liquidated damages, attorney fees and court costs. He is represented by attorney Josh Sanford of Sanford Law Firm in Little Rock, Ark.
