GE sues to recover allegedly unpaid vehicles, loans

General Electric Capital Corp. is suing two companies and two affiliated individuals over allegedly unpaid loans.

The plaintiff filed the suit Aug. 21 in the Houston Division of Southern District of Texas against Mackzilla LLC, Vaczilla Trucking LLC, Dominick Ditcharo and Crystal Ditcharo, citing breach of contract.

According to the complaint, the defendants took out 11 loans for the purchase of tractor-trailers beginning in October 2011 through August 2012. The plaintiff claims the parties are in default and have failed to make payments under the loan agreements. While the plaintiff has recovered some of the vehicles, five are still in the defendants' possession and the plaintiff is suing to get them back.

The plaintiff seeks a judgment in the amount due under the loan agreements, attorneys' fees and court costs.

The plaintiff's attorneys are Benjamin D. West of Reed Smith LLP in Houston and Aaron B. Chapin of Reed Smith LLP in Chicago.
