HOUSTON -- A Texas RV owner is suing a manufacturer and Houston dealer, alleging he was sold a defective travel trailer that the dealer failed to repair properly.
David Holderfield filed a lawsuit Sept. 9 in the Houston Division of the Southern District of Texas against Forest River Inc. and Fun Town RV Houston LLC, manufacturer and dealer respectively of the vehicle.
According to the complaint, on Jan. 10, Holderfield purchased a 2015 trailer from the defendants for nearly $41,000. Despite the implied and express warranties, and multiple return visits to the dealer, the suit says, the vehicle's defects were never properly fixed by the defendants.
The lawsuit alleges violations of the Texas Deceptive Trade Practices Act and the Magnuson-Moss Warranty Act, breach of express and implied warranties, negligence and negligent misrepresentation, breach of contract, and negligent repair.
Holderfield seeks economic and actual damages, damages for mental anguish, rescission of ownership of the vehicle and the return of his down payment and other fees, plus attorney fees, court costs and a jury trial. He is represented by attorney Richard C. Dalton of Mandeville, La.
