Employee sues nursing home over on-the-job injuries and allegedly inadequate care

A Galveston County woman is suing a nursing home facility and the companies that operate it, claiming that they failed to provide her with proper medical care and treatment when she was severely injured while at work.

Pauline Douglas filed a lawsuit July 31 in Galveston County District Court against Oceanview Healthcare Inc., The Ensign Group Inc., and Keystone Care LLC, alleging negligence, fraud and negligent misrepresentation.

According to the filing, Douglas began working for Oceanview Healthcare as an assistant director of nursing in February 2013. Despite the defendants assuring employees that they offer medical coverage and protection for on-the-job injuries through Standardbearer Insurance Co., Douglas alleges she wasn't given such coverage after she was injured while in the course and scope of her employment in July 2013.

Moreover, the suit states that Douglas was injured as the result of the defendants' failure to provide a safe workplace through not furnishing safe instrumentalities, not adequately supervising their employees, and not warning her of the dangers associated with the job.

The lawsuit says the defendants actions were done maliciously and with a conscious indifference to the health, safety and welfare of Douglas. Douglas claims she has and will continue to suffer physical pain, physical impairment and disability, mental anguish, lost wages, medical expenses and lost earning capacity.

Douglas seeks actual damages, punitive damages, court costs and other relief deemed appropriate by the court.

The plaintiff is being represented by attorney J. Alfred Southerland of Shellist, Lazarz & Slobin LLP in Houston.
