HOUSTON -- AIG seeks declaratory relief in its suit against a Gregory aluminum company.
AIG Specialty Insurance Company filed a lawsuit Sept. 17 in the Houston Division of the Southern District of Texas against Sherwin Alumina Company of Gregory.
According to the complaint, Sherwin sought covered damages from AIG for the spread of industrial waste from its storage site to neighboring properties. However, AIG alleges the defendant canceled its policy after only six months of coverage.
The plaintiff says Sherwin is trying to reclassify the situation so it is covered under a different section of the policy.
AIG seeks a judicial declaration of its rights and duties under the policy, including that the claims are not covered, it has no duty to indemnify the defendant under any other policy, and it has no coverage obligation to Sherwin Alumina. The plaintiff also seeks attorney fees and court costs. It is represented by attorneys Scott L. Davis and Matthew J. Schroeder of Dallas.
