Denton worker blames Select Physical Therapy for work-related injury

SHERMAN -- A Denton County man is suing a physical therapy clinic, alleging negligence for a work-related injury.

Darrell Sabadach filed a lawsuit Sept. 18 in the Sherman Division of the Eastern District of Texas against Select Physical Therapy LP, alleging employer negligence.

On May 20, the complaint states, Sabadach was performing maintenance work assigned by Select Physical Therapy. While attempting to secure a part on a toilet using tools the defendant supplied, the suit says, the plaintiff felt a sharp pain in his right shoulder.

An orthopedic surgeon selected by the defendant diagnosed Sabadach with a rotator cuff tear caused by the work he was performing at the time of the injury, the lawsuit states. The surgeon recommended surgery to repair the shoulder damage, but the defendant has refused to provide the surgery, the complaint says.

The suit states the defendant was negligent in failing to provide a reasonably safe place to work and supply reasonably safe equipment, tools, and appliances, among other negligent acts or omissions.

Sabadach seeks damages in an amount exceeding the minimum jurisdictional limits of this court, plus court costs. He is represented by attorney Tom Carse of Carse Law Firm in Dallas.
