Worker alleges Santanas Concrete failed to pay overtime wages

HOUSTON -- A Bosque County man is suing a concrete and masonry contractor, alleging unpaid overtime.

Pablo Alba Garcia, individually and for all others similarly situated, filed a collective action complaint Sept. 16 in the Houston Division of the Southern District of Texas against Santanas Concrete, Inc. and Santana Diaz, alleging unpaid overtime wages and failure to maintain accurate records in violation of the Fair Labor Standards Act.

The complaint alleges during Garcia's employment with Santanas, he was paid on an hourly basis and regularly worked in excess of 40 hours per week, but he was not paid time-and-a-half for time worked more than 40 hours per week.

The suit says the defendants failed to maintain accurate time and pay records for the plaintiff. 

Garcia and others in the class seek to recover unpaid overtime wages, liquidated damages, plus attorney fees and court costs. Garcia is represented by attorney Melissa Moore and Curt Hesse of Moore & Associates in Houston.
