Harris County man alleges excessive force by Webster, Nassau Bay police

GALVESTON -- A Harris County man is suing police officers from Webster and Nassau Bay, alleging excessive force. 

John Scott Joiner filed the lawsuit Sept. 23 in Galveston County District Court against police officers Colin Murphy, Peter Behler and the city of Webster, where they work, alleging assault, battery and excessive force.

According to the complaint, on Sept. 24, 2013, the officers beat Joiner excessively, violating his civil rights, after he surrendered. However, the suit says, the defendants hit, bit, kicked and ultimately Tased Joiner, resulting in a laryngeal fracture, broken nose, broken teeth, cut and bruised gums, eye and rib contusions and taser burns.

As a result, the plaintiff says he has incurred medical expenses and will continue to suffer the consequences of his injuries. 

Joiner seeks a jury trial to decide actual, incidental, direct, consequential, economic, special, nominal, general and emotional damages, court costs, attorney fees and interest.  He is represented by attorney John A. Buckley Jr. of Greer, Herz & Adams LLP in League City.
