Employee alleges UT Medical Branch, Galveston guilty of race discrimination

GALVESTON--A Galveston County woman is suing a University of Texas medical branch, alleging employment discrimination and retaliation.

Alicia Guajardo filed a lawsuit Sept. 28 in Galveston County District Court against the University of Texas Medical Branch, Galveston.

Guajardo, plaintiff, a Hispanic female, began working at the medical facility as a nurse supervisor Aug. 17, 2000, and her most recent manager was Samantha McBroom, who is white. 

According to the complaint, after a situation regarding expired medication, the plaintiff says she was given a written reprimand, while a co-worker, who is black, received a warning over the phone. After Guajardo complained to the employee relations/human resources department Aug. 1, 2013, the plaintiff says she was demoted after her supervisor said she "displayed insubordination."

The plaintiff alleges her demotion is a result of race/national origin discrimination and retaliation. 

Guajardo seeks a jury trial, reinstatement to her former position, damages, a directive by the court that the defendant's actions violated the Texas Commission on Human Rights Act, court costs and attorney's fees. She is represented by attorney Peter Costea of Houston.
