Jefferson County man sues KCSR, alleging negligence in rail yard accident

A Jefferson County man is suing a railroad company, alleging negligence for injuries he sustained during a rail yard collision.

Kerry L. Thomas filed a lawsuit Sept. 17 in Jefferson County District Court against The Kansas City Southern Railway Company (KCSRC), alleging negligence.

On Sept. 12,  the complaint states, while Thomas was employed by KCSRC, he was thrown off or jumped off a moving rail car in a collision during switching operations in a poorly lit rail yard.

The suit says the defendant was negligent in failing to provide a safe place to work, failing to follow applicable rules and regulations, failing to provide adequate lighting, and failing to comply with industry standards, among other negligent acts or omissions.

As a result, the suit states, the plaintiff sustained injuries to his right shoulder and back, physical pain and suffering, mental anguish, physical impairment and disfigurement, lost earnings and earning capacity, and has incurred medical expenses.

Thomas seeks monetary relief of more than $1 million, plus costs of the suit. He is represented by attorney Bristol Baxley of Rome, Arata & Baxley in Pearland.
