Ex-emloyee sues Wastewater Specialties, alleging unpaid overtime wages

A Jefferson County man is suing an industrial cleaning services company, alleging unpaid overtime.

Jarvis Simon, individually and for all others similarly situated, filed a collective action lawsuit Sept. 25 in the Beaumont Division of the Eastern District of Texas against Wastewater Specialties Inc., alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

According to the complaint, when Simon was employed by Wastewater as an operator, from July 2013 to June 2015, he was paid on an hourly basis. The suit says Simon regularly worked more than 40 hours per week but was not paid time-and-a-half for hours worked more than 40 hours, and the defendant failed to maintain accurate time and pay records for the plaintiff and other similarly situated individuals.

Simon and others in the collective seek to recover unpaid overtime wages, liquidated damages, plus attorney fees and court costs. The plaintiff is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
