Galveston County man sues businesses, alleging negligence in fall

A Galveston County man is suing several businesses, alleging negligence for injuries he sustained while examining a roof.

David Watson filed the lawsuit Sept. 23 in Galveston County District Court against Mitchell Historic Properties Inc., Fred Hartel Company, doing business as Hartel Roofing & Sheet Metal, Building Galveston Inc., doing business as Building Solutions, Smothers General Investment Company Inc. and Hendley Market International, alleging negligence.

According to the complaint, on Oct. 1, 2013, Watson was called to Hendley Market, 2010 Strand St., Galveston, to inspect a leaking roof. In the course of his work, the suit says, the plaintiff entered the attic of the structure, whereupon he and another person fell through the attic floor onto the third floor below.

As a direct result of the defendants' negligence, the plaintiff sustained injuries, physical pain and suffering, mental anguish, disfigurement and physical impairment. He also had to secure medical attention, and could need the same in the future.

Watson seeks damages for the aforementioned injuries, interest, court costs, attorney fees and a trial by jury. He is represented by attorneys Darrell A. Apffel, S. Benjamin Shabot and Lauren F. Arisco of Bettison, Doyle, Apffel & Guarino in League City.
