Houston construction company alleges Friendswood couple failed to pay for work

GALVESTON--A Houston construction company is suing a Friendswood couple, alleging it did not get paid for work provided.

U.S. Construction Services filed a lawsuit Sept. 30 in Galveston County District Court against Gary Morgan and Susan Morgan, alleging violations of the Texas Prompt Bay Act and breach of contract.

According to the complaint, on Oct. 15, 2014, the Morgans signed a contract with U.S. Construction for a renovation of their home in Friendswood that had been damaged by fire and water. 

On April 3, 2015, the suit says, the plaintiff received a letter from the defendants that they were terminating the contract and said they owed U.S. Construction 27,000. The plaintiff, however, alleges the actual amount owed is closer to $72,000. 

With no response from the defendants about the discrepancy, the plaintiff filed a lien against the property, 1202 Cowards Creek Drive, Friendswood.

U.S. Construction Services seeks a foreclosure on the defendants' property, attorney fees, interest and court costs. It is represented by attorneys John. J. Patout Jr. and Martin C. Law of Patout & Shaw PLLC in Stafford.
