GSV Transportation and driver sued over alleged negligence in I-10 vehicle collision

A Texas man is suing a transportation company and one of its drivers over injuries he sustained in a vehicle collision.

Bradford Shane Cooper Jr. filed a complaint Sept. 25 in U.S. District Court for the Houston Division of the Southern District of Texas against Richard M. Rincon and GSV Transportation Inc., alleging negligence.

On Nov. 2, 2013, the complaint states, Cooper was driving his 1999 Ford Contour eastbound on Interstate 10 in Houston, when Rincon, driving a 2013 Freightliner towing a 2011 Wabash National Corp. trailer in the scope of his employment with GSV, attempted to change lanes and caused a collision between the two vehicles.

The complaint states that Rincon was negligent in failing to pay proper attention, failing to maintain his vehicle within a single marked lane, attempting to change lanes when unsafe, and using a mobile device while operating a motor vehicle, among other negligent acts or omissions.

As a result, Cooper sustained injuries, physical pain and mental anguish, disfigurement and impairment, loss of wages and earning capacity, and has incurred medical expenses.

Cooper seeks damages of more than $75,000, plus interest and court costs.
