Tech consulting firm alleges Kye Systems did not pay commissions

A Montgomery County technology consulting firm is suing a California computer manufacturer, alleging it has not been paid for services rendered.

Engage Consulting filed a lawsuit Oct. 2 in the Houston Division of the Southern District of Texas against Kye International Corp. and Kye Systems Corp. of Chino, Calif.

Since 2002, both parties have executed commission agreements in which the defendants appoint Engage as their exclusive sales representative. 

According to the complaint, Kye partially compensated the plaintiff for a period of time but then the payments stopped altogether. Engage alleges it also discovered Kye had hidden customers, relationships, sales and commissions from the plaintiff. 

Engage seeks all damages, an order enforcing the commission agreements, attorney fees and court costs. It is represented by attorney Kirby D. Hopkins of Drucker Hopkins in The Woodlands.
