HOUSTON – A Tennessee man has filed suit over his employer's alleged failure to pay overtime wages.

Wesley Boleware filed the suit Oct. 1 in the Houston Division of the Southern Division of Texas against Seadrill Americas Inc., Dallas, citing violations of the Fair Labor Standards Act.

According to the complaint, the plaintiff has worked for the defendant, most recently as a roughneck, since Oct. 17, 2014. He says he has never received mandated time-and-a-half wages for a work week that exceeded 40 hours, as required under FLSA. Further, he is required to attend pre- and post-work meetings but isn't paid for that time either, the suit claims.

The plaintiff seeks collective action status for himself and his co-workers similarly situated.

In addition to a trial by jury, the plaintiff seeks unpaid overtime compensation, liquidated damages, attorneys' fees and court costs, and incentive awards for any class representatives.

Representing the plaintiff are Melissa Moore, Rochelle Owens and Curt Hesse of Moore & Associates in Houston.
