Motorist sues estate of dead man, alleging negligence in vehicle collision

A motorist is suing the estate of a deceased man over injuries the plaintiff sustained in a vehicle collision with the defendant.

Rod Alvarez filed a lawsuit June 26 in Jefferson County District Court against the estate of deceased Abraham H. Hernandez, alleging negligence.

On March 13, 2014, the complaint states, Alvarez was traveling northbound on 9th Avenue in Port Arthur, when Hernandez, also traveling northbound on 9th Avenue, rear-ended Alvarez's vehicle. The suit says Hernandez, who died later, was negligent in failing to maintain proper lookout, failing to operate his vehicle in a safe manner, speeding, and other negligent acts or omissions.

As a result, the lawsuit states, the plaintiff sustained injuries to his spinal cord and body in general, pain and suffering, mental anguish, impairment, loss of wages and earning capacity, and has incurred medical expenses.

Alvarez seeks damages, interests and court costs. He is represented by attorney Tommy L. Yeates of Moore Landrey in Beaumont.
