A Nueces County man is suing oilfield waste management companies, alleging unpaid overtime wages.

Noe Galvan Garcia Jr., individually and for all others similarly situated, filed a lawsuit Sept. 30 in the Houston Division of the Southern District of Texas against Sprint Energy Services and Sprint Waste Services, alleging unpaid overtime in violation of the Fair Labor Standards Act.

The complaint states while Garcia was employed by the defendants as an oilfield service worker, he routinely worked in excess of 40 hours per week. Garcia was paid a flat day rate but, the complaint alleges, was not paid time-and-a-half for time worked more than 40 hours per week, the suit says.

Garcia and others in the class seek to recover unpaid overtime compensation, liquidated damages, costs of the suit, attorney fees and interest. Garcia is represented by attorneys J. Derek Braziel and Jay Forester of Lee & Braziel in Dallas, and Jack Siegel of Siegel Law Group in Dallas.

Houston Division of the Southern District of Texas case number 4:15-cv-02848.
