Ex-employee alleges Active Athlete failed to pay overtime, minimum wages

A former employee is suing a shoe company and its owner, alleging unpaid overtime and failure to pay minimum wages.

Maria Consuelo Aguirre Flores filed a complaint Oct. 9 in the Houston Division of the Southern District of Texas against Active Athlete and Paul Seernani, alleging unpaid overtime and minimum wages in violation of the Fair Labor Standards Act.

The complaint states that when Flores was employed by the defendants as a general housekeeping and retail sales worker at their store on Cullen Boulevard in Houston, she regularly worked 60 hours per week, for which she was paid a salary rate.

The suit alleges Flores was not paid an overtime premium for time worked more than 40 hours per week, and was not paid the federally mandated minimum wage.

Flores seeks to recover unpaid overtime compensation and liquidated damages, plus attorney fees and court costs. She is represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
