Galveston woman sues Michocana Restaurant, alleging negligence in accident

A Galveston woman is suing a Texas City restaurant, alleging negligence for injuries she says she sustained in a fall.

Consuelo Ochoa filed a lawsuit Oct. 13 in Galveston County District Court against La Barranquilla, doing business as Michocana Restaurant and Taqueria, alleging negligence.

On Dec. 16, 2014, the complaint states, Ochoa, 86, entered Michocana Restaurant and Taqueria, at 2525 Loop 197 North in Texas City, and became entangled in a floor mat and fell. The mat had been spread over an area where soda had just been spilled, the suit says.

The lawsuit alleges the defendant was negligent in failing to properly clean the soda, failing to properly spread the mat, and leaving an obstruction on the mat.

As a result, the plaintiff sustained a left arm and wrist fracture. She was taken from the restaurant by ambulance to the Mainland Hospital, where she received treatment for injuries to her left arm and wrist, and for bruises on her left shoulder, left knee and hip.

Ochoa seeks damages and interest. She is represented by attorney George D. Martin of Martin, Garza & Fisher in Galveston.
