Orange County man sues Franks Trucking, driver in vehicle collision

An Orange County man is suing a trucking company one of its drivers, and the trailer owner alleging negligence for injuries he sustained in a vehicle collision.

Mario Servin filed a lawsuit Oct. 7 in Jefferson County District Court against Franks Trucking, Kevin Dewayne Drake of Port Arthur and Gilbert Williams of Nederland, alleging negligence and gross negligence.

On June 24, the complaint states, Servin was driving northbound on Texas Avenue in Orange County, when Drake, driving an 18-wheeler owned by Franks Trucking and towing a trailer owned by Williams, collided with Servin's vehicle.

The suit says Drake was negligent or grossly negligent in failing to control speed, disregarding a red light, failing to operate safely and keep proper lookout, failing to maintain a safe distance, and other negligent acts or omissions.

The complaint further alleges Franks Trucking and Williams were negligent or grossly negligent in entrusting a motor vehicle to an incompetent driver, negligently hiring and/or retaining employees, negligently training and/or supervising employees, and other negligent acts or omissions.

As a result, the suit says, the plaintiff was seriously injured and has sustained pain and suffering, mental anguish, impairment and disfigurement, loss of wages and earning capacity, and medical expenses.

Servin seeks monetary relief of more than $1 million, including interests, attorney fees and court costs. He is represented by attorney John Arthur Daspit, Robert Morse and Kiernan McAlpine of the Daspit Law Firm in Houston.
