An employee is suing a Tyler oilfield services company, alleging it incorrectly calculated overtime compensation.
Orlando Guerra, individually and for all others similarly situated, filed a complaint Oct. 20 in the Houston Division for the Southern District of Texas against Torqued-Up Energy Services, alleging incorrect overtime wages in violation of the Fair Labor Standards Act.
The complaint alleges during the time Guerra worked for the defendant as an equipment operator, he regularly worked more than 84 hours per week and was paid on an hourly basis, plus non-discretionary job bonuses/day rates.
The suit says the defendant did pay overtime but did not include the non-discretionary job bonuses in calculating Guerra's regular rate of pay, as required by federal law.
Guerra and others in the class seek to recover overtime compensation, liquidated damages, attorney fees, and costs. He is represented by attorneys Clif Alexander and Austin W. Anderson of Phipps Anderson Deacon in Corpus Christi.
