Couple alleges Cruiser Yachts negligent in sale of luxury yacht

GALVESTON -- A Galveston couple is suing the sellers and manufacturers of a luxury yacht, alleging defects and recurring problems.

John Harvard and Carrie Derkowski, filed a lawsuit Oct. 21 in Galveston County District Court against Cruisers Yachts Division of KCS International, the Nautic Group Inc., Brunswick Corp. and Kohler Company, alleging fraud, negligent misrepresentation and breach of contract. 

According to the complaint, on July 4, 2013, the plaintiffs were knowingly mislead into purchasing the $429,000 Cruiser 310 model and that the options Harvard desired, and were were available on other models, were not offered, and recurring defects were not corrected in a timely and workmanlike manner.

Harvard and Derkowski seek more than $200,000, plus attorney fees and costs of litigation. They are represented by attorney Angel E. Hagmaier of Galveston.
